Filing a Tax Return During a Memphis, Tennessee Divorce Case

The only way you can file a joint tax return is if you and your spouse were married on the last day of the year. If you decide to file jointly, you may pay fewer taxes, although this is not always true.
One issue that may arise in these situations is that of a tax refund. Who collects it? If you filed jointly, take the necessary steps to ensure that any refunds will be issued in both your and your ex-spouse’s names. Whichever spouse actually receives the refund should then split it with the other spouse in whichever amount is agreed upon.
You also have the option of filing as “married filing separately” or filing as “head of household.” These options may separate the tax liability of the spouses, but before you go this route, be sure to check whether this would be beneficial in your case.
There are several tax implications that can affect a divorce, such as those pertaining to the assets from the marriage and any child/spousal support.
