A Collaborative Divorce is NOT the same as Uncontested Divorce in Tennessee

While there are many similarities between an uncontested Tennessee divorce and a collaborative divorce, they are NOT the same matter, nor are they settled in the same process. Before you make the decision to file for divorce, it’s important to understand the differences between these two methods.
Perhaps the most important difference is that an uncontested divorce may still have to go before the court. The purpose of a collaborative divorce is to avoid the court completely through the settlement process. An uncontested divorce will still require appearances before a family law judge to assess a final decision on your case.
With an uncontested divorce, it IS possible to settle without the help of a divorce lawyer, but it is not so with a collaborative divorce. You must have a divorce lawyer acting on your behalf to enter the negotiation process with your ex-spouse’s lawyer. This is done not only to help provide you with legal guidance, but also to protect you from being taken advantage of in the settlement process.
While both forms of divorce are generally more amicable than a contested divorce, they are not without some negotiation and frustration. By working with your divorce lawyer and letting him or her take the initiative in the negotiations for your divorce settlement, you can focus on getting your life back on track.
