This presentation is oriented toward helping the family law attorney understand business tax returns for purposes of identifying income for child support purposes. The attorney who represents the parent with self-employment or partnership income must understand the forms and tax returns in order to explain it to the judge. The attorney who represents the other spouse is probably suspicious that the self-employed parent is “hiding” money somewhere in the tax return, and wants to find out where it is. It will be beneficial to all family law attorneys to improve understanding of these returns, schedules, and what they mean, for purposes of calculating child support.
Tax forms to be discussed include:
- 1040
- Schedule C
- Schedule E
- Schedule K-1 (Form 1065)
- Schedule K-1 (Form 1120S)
- Schedule K-1 (Form 1065-B)
- Form 4506-T
