Tennessee’s Presumptive Child Support Order: Child Support Amount Owed Before Deviations under the Tennessee Child Support Guidelines
In Tennessee, reaching the presumptive child support order (PCSO) amount means you are almost done with the calculation. The PCSO is the child support award after the calculation considering the parents’ income, parenting time, and other expenses, but before consideration of deviations.
Note that deviations can be added for any number of reasons. In reviewing settlements, judges will scrutinize downward deviations even if agreed upon by the parents, but will not usually question upward deviations. Keep in mind that long-distance travel costs for visiting with a relocated parent can be a deviation, too.
Plus, note the requirement that the Worksheets must be included as part of the official record. This means that the Child Support Worksheets should be attached to the actual child support order which is normally the Permanent Parenting Plan itself.
Here is the Tennessee Child Support Guidelines definition of PCSO:
(11) Presumptive Child Support Order.
(a) The Presumptive Child Support Order (PCSO) is the result of the calculations under these Guidelines, rounded to the nearest whole dollar, and is the amount of support for which the obligor is responsible prior to consideration of any deviations.
(b) Deviations from this amount must be supported by written findings in the support order, as required by 1240-2-4-.07(1).
(c) The completed Worksheet(s) must be maintained as part of the official record either by filing them as exhibits in the tribunal’s file or as attachments to the order.
(d) Payments of child support shall be ordered to be paid in a specific dollar amount on a weekly, biweekly (every two weeks), semi-monthly, or monthly basis.
