An Uncontested Tennessee Divorce Can Settle in as Little as 60 Days

One of the main reasons you may seek an uncontested divorce is to speed up the process of finalizing the end of your marriage. The uncontested divorce process can be much shorter than a contested divorce because it negates the need for a court hearing and trial to approve the final resolution.
When an uncontested divorce is filed purely on the grounds of irreconcilable differences, the timeframe for finalization can be as little as 60 days. This is possible if the plaintiff (spouse initiating the divorce) and respondent (other spouse) act quickly to agree upon the terms of the divorce.
Once these agreements are met, the Marital Settlement Agreement is prepared, typically with the help of one or more divorce attorneys, and submitted to the Clerk of Courts for review. The faster this process goes, the sooner a Final Decree can be granted to finalize the divorce.
The 60-day approval period may be possible only when there are no minor children involved in the marriage. If the couple does have minor children to consider in their agreement, there are additional steps, such as drafting an approved Parenting Plan and providing for the care and wellbeing of the children in their agreement.
