What is an Uncontested Tennessee Divorce?

When you file a petition for divorce in which both spouses agree that the marriage should be terminated because of irreconcilable differences, it may be known as an uncontested divorce. This basically means that both spouses agree they can no longer cohabitate as husband and wife, and their marriage should legally end.
This may seem like a simple and straightforward process, but under family law in Tennessee, you still must undergo the steps of:
- filing;
- negotiating; and
- settling an uncontested divorce.
For couples with minor children, jointly owned assets, or family businesses, a divorce case can become very complex.
Most uncontested divorce cases can be handled by filing a Marital Dissolution Agreement, which can speed up the process by avoiding the courts.
