In the June 2020 issue of DeSoto Magazine, Miles Mason, Sr. is featured in the article, “A Wise Step Before Marriage” by Jackie Sheckler Finch. The article concerns prenuptial agreements, with Mason explaining why they can be beneficial to both parties in a marriage, not just the wealthier spouse, as is often assumed.
Prenuptial agreements concern the division of property and assets upon divorce or the death of one spouse. Without a prenuptial agreement, state law will control the division of assets in either situation.
The use of prenuptial agreements has increased in recent years, which Mason suggests in the article is possibly due to the increased likelihood of people marrying later in life or multiple times. In these cases, prenuptial agreements protect property accumulated in the years before the marriage and also provide security for spouses who leave their employment due to the marriage. In the case of second marriages, one or both parties may also have children from a previous marriage. A prenuptial agreement can be effective in protecting the interests of those children.
Mason also advises in the article that each spouse obtain a separate lawyer before arranging the prenuptial agreement and reminds readers of the necessity of each spouse disclosing all financial assets and debts in the process.
